Boom gates in residential areas legal, rules Federal Court

The Federal Court has ruled that the use of boom gates across public roads and guardhouses in residential areas is legal.

A five-member panel, chaired by Chief Judge of Malaya Tan Sri Zulkefli Ahmad Makinudin, said regulated access to a defined area was not an obstruction in law, particularly if it was for security purposes.

"It is so only if one is denied access to a public place. It is not a barricade that is placed across a public road that denies access altogether to all who wish to enter," said Justice Zulkefli in his 18-page judgment delivered on March 19.

He said guardhouses and boom gates were authorised structures under the Town and Country Planning Act 1976, the Street, Drainage and Building Act 1974 as well as the Local Government Act 1976.

"It cannot be disputed that guarded communities are schemes implemented to improve public safety and security in defined residential areas," he said.

The panel dismissed an appeal brought by Au Kean Hoe, a resident of the D'Villa Equestrian housing estate in Kota Damansara, Petaling Jaya, Selangor, who had commenced legal action against the D'Villa Equestrian Residents' Association.

Au claimed that the guardhouse and two boom gates built in the housing estate ought to be demolished because they were illegal structures, a nuisance and amounted to an obstruction.

Justice Zulkefli said the Petaling Jaya City Council (MBPJ), as the relevant local authority in the present case, was fully empowered to approve the guardhouse with the boom gates in accordance with MBPJ guidelines for guarded communities issued by the Urban Planning Department in May 2011.

He said the developer of the housing estate obtained approval from MBPJ for the construction of the guardhouse.

Justice Zulkefli said both the High Court and the Court of Appeal had correctly concluded that Au's claim of inconvenience caused by the presence of the guardhouse and boom gates was not an actionable nuisance.

In Aug 2010, Au ceased to be a member of the residents' association of the housing estate and stopped paying maintenance and security charges of RM250 per month, which was later reduced to RM200.

Au lodged a police report and an online complaint on the MBPJ website after the association issued a circular on Oct 25, 2011, notifying residents that those who had not paid the security and maintenance charges would have to open the boom gates themselves without the assistance of the security guard on duty.

He subsequently commenced legal action on the grounds of nuisance while the association made a counter claim for arrears of security and maintenance charges and also sought an injunction order to restrain him from harassing the association and the security guards at the guardhouse.

The High Court dismissed Au's claim but allowed the association's counter-claim and issued the injunction order. Au lost his appeal in the Court of Appeal.

Au was represented by a team of lawyers led by Datuk Malik Imtiaz Sarwar while the association was represented by a team of lawyers led by Datuk Dr Cyrus Das.

New Project Behind Mahkota Hills


There is a new project (21 storey, 420 units) coming up behind Jalan Mahkota Hills 1.

The project will affect the traffic and security of the community.

The number of house and traffic will increase by 211%.

The massive piling work will damage the house at Jalan Mahkota 10 & Mahkota Hills.

There is no proper access/main road link to this project. 

The traffic will flow through a bottle neck at Jalan Mahkota 7 which is a 40' wide road.

有一个新的项目(21层,420个单位)在Jalan Mahkota Hills 1 后面。

该项目将严重的影响本社区的交通流量和治安。房子和交通流量的将增加超过211%。

大量的打桩工作会破坏第10和 Hills 路的房屋。此项目没有合适的主要道路连结。

此计划将带来严重的交通瓶颈,交通需经过只有40尺宽的第7路。

Base on the project plan, the main access for the project is at Jalan Mahkota 9.

Cadangan Penduduk Bandar Mahkota Cheras

Pengenalan
  • East Klang Valley Expressway (EKVE) adalah lebuhraya bertol menghubungkan rantau selatan Kuala Lumpur ke Karak Expressway. 
  • Ia berfungsi sebagai pintasan trafik antara rantau Pantai Timur, dan rantau utara dan selatan Kuala Lumpur.
  • Ia menyediakan laluan pintas untuk trafik di antara bandar yang tidak perlu melalui pusat bandar Kuala Lumpur.
  • EKVE ialah laluan pintas untuk trafik dari Cheras, Balakong, Kajang, Bangi ke bahagian timur dan utara Kuala Lumpur seperti Ampang, Selayang, Gombak atau sebaliknya. 
  • EKVE adalah sebahagian daripada Kuala Lumpur Outer Ring Road (KLORR).
  • Satu persimpangan bertingkat akan dibina untuk menyambung EKVE dengan Persiaran Cheras Mahkota di bahagian timur Bandar Mahkota Cheras.
  • Persiaran Mahkota Cheras sekarang berhubung dengan Cheras-Kajang Expressway dengan persimpangan lampu isyarat di bahagian barat Bandar Mahkota Cheras.

Masalah Kesesatan Lalulintas

Masalah kesesatan lalulintas yang sangat serius akan berlaku di Persimpangan Persiaran Mahkota Cheras dan Cheras-Kajang Expressway.
  • Persiaran Mahkota Cheras akan menjadi jalan yang berhubung 2 lebuhraya, iaitu Cheras-Kajang Expressway (CKE) dengan EKVE. 
  • Apabila EKVE siap dibina pada 2018, trafik yang melalui Persiaran Mahkota Cheras dijangka akan naik mendadak. 
  • Trafik di sekitar Balakong & Cheras akan melalui Persiaran Mahkota Cheras ke EKVE untuk menujuk ke Pantai Timur dan KL timur/utara dan sebaliknya. 
  • Kesesakan lalu lintas yang sudah serius pada masa sekarang di Persimpangan Persiaran Mahkota Cheras dan Cheras-Kajang Expressway akan menjadi semakin teruk.
  • Persimpangan lampu isyarat pada masakini tidak dapat menapung jumlah trafik dengan perkembangan baru ini.
  • Dijangka pada masa itu persimpanagan ini akan mengalami "Super Traffic Jam".

    Cadangan

    Kami minta Kerajaan Negeri Selangor dan Kementerian Kerja Raya berkerjasama untuk menaikan taraf sistem trafik di sekitar Bandar Mahkota Cheras untuk mengelakan keadaan kesesatan lalulintas yang serius pada masa depan.

    Kami mencadangkan kaedah dengan kos yang rendah supaya ia dapat dibina dengan segera.

    Kami mencadang 2 jejambat dibina untuk meringankan seseatan lalulintas.

    Pertama
    Satu jejambat U-turn (seperti di hadapan Taman Segar, Cheras) dibina di atas Cheras-Kajang Expressway di sebelah kiri dari Persimpangan Persiaran Mahkota Cheras dan Cheras-Kajang Expressway.

    Kedua
    Satu jejambat menghubungkan Jalan Sg Long dengan Lebuhrata SILK supaya lalulintas dapat terus ke Balakong dan mengelakan kesesatan di Persimpangan Jalan Sg Long dan Cheras-Kajang Expressway.


    Kami minta Kerajaan Negeri Selangor dan Kementerian Kerja Raya menjalankan kajian kemungkinan (feasibility study) dengan serta merta kerana EKVE akan siap dibina pada 2018.


    Cheras-Kajang Expressway dan Lebuhraya SILK



    Pertama: Cadangan di Cheras-Kajang Expressway 

    Membina satu jejambat U-turn ke arah KL di Cheras-Kajang Expressway dari bahagian kiri Persimpangan Persiaran Mahkota Cheras dan Cheras-Kajang Expressway.



    Kedua: Cadangan di Lebuhraya SILK

    Membina satu jejambat menyambung Jalan Sg Long dengan Lebuhraya SILK supaya lalulintas dari Bandar Mahkota Cheras dan Sg Long boleh terus masuk melalui SILK ke Balakong.
